These terms and conditions apply to all collaborations, projects, and services provided by BONFIRE ApS (“BONFIRE”, “we”, “us”, or “our”) unless otherwise agreed in writing.
Scope of Services
BONFIRE is a creative agency specializing in brand activations, cultural strategy, and experiential marketing.
Our services may include, but are not limited to:
Creative development and concept design
Production of brand activations and events
Visual content and digital storytelling
Partnerships, strategy, and campaign execution
Consulting and brand collaborations
Each project or campaign is governed by an individual agreement outlining scope, deliverables, timelines, and pricing.
Payment Terms
Unless otherwise stated in a written agreement, all invoices are payable net 14 days from the date of issue.
In the event of late payment, BONFIRE reserves the right to charge statutory interest and administration fees in accordance with Danish law.
All prices are stated in DKK (Danish Kroner) and are exclusive of VAT unless otherwise specified.
Ownership of all creative work, materials, and deliverables remains with BONFIRE until full payment has been received.
Confidentiality and Data Privacy
All client information, creative materials, and project data are treated with strict confidentiality.
BONFIRE will never share or sell your data to third parties without consent.
You can read more about how we collect, store, and process data in our Privacy Policy.
Delivery and Deadlines
Project delivery timelines are agreed upon individually for each client.
BONFIRE strives to meet all agreed deadlines, but delays caused by factors outside our control (e.g., client revisions, supplier delays, or force majeure) may affect the timeline.
All services are considered delivered when the agreed deliverables have been completed and shared with the client.
Cancellations and Refunds
Creative services, productions, and campaigns are tailor-made for each client and are therefore non-refundable once initiated.
If a project is cancelled by the client before production has begun, the client will be invoiced for time spent and any non-refundable costs incurred.
If cancellation occurs after project commencement, BONFIRE reserves the right to invoice for the full or partial contract value depending on progress and commitments made.
Use of Materials and Intellectual Property
All creative concepts, visual materials, and strategies developed by BONFIRE remain the intellectual property of BONFIRE unless otherwise agreed in writing.
Clients receive usage rights to the final approved materials for the purposes agreed upon in the project contract.
Use beyond the agreed scope — such as resale, sublicensing, or redistribution — requires written consent from BONFIRE.
Visual Documentation
During projects, BONFIRE may document events, activations, and productions through photography or video for internal use, case studies, and marketing purposes.
By entering into a collaboration with BONFIRE, you agree that such documentation may be used for promotional purposes (e.g., website, social media, or presentations) unless otherwise stated in writing.
If you wish to opt out of this, please contact us at contact@bonfireagency.com.
Partners and Third-Party Vendors
In some cases, BONFIRE works with external partners, suppliers, or subcontractors to deliver services.
We only collaborate with trusted vendors who comply with data protection and quality standards.
BONFIRE cannot be held responsible for errors, delays, or damages caused by third-party suppliers outside our direct control.
Liability
BONFIRE’s liability for any claim related to a project or service is limited to the amount invoiced for that specific project.
We are not liable for indirect losses such as operational loss, loss of profit, or data loss.
BONFIRE cannot be held responsible for delays, damages, or non-performance resulting from circumstances beyond our reasonable control, including but not limited to force majeure, supplier failure, natural disasters, government restrictions, or other unforeseen events.
Force Majeure
BONFIRE is not liable for failure or delay in performance due to causes beyond our reasonable control, including — but not limited to — war, civil unrest, natural disasters, fire, strikes, pandemics, government restrictions, or system breakdowns.
In such cases, BONFIRE reserves the right to postpone or cancel the affected obligations without liability.
Complaints and Disputes
If you have questions, concerns, or wish to file a complaint regarding a project or experience with BONFIRE, please contact us directly at contact@bonfireagency.com.
If a dispute cannot be resolved directly, it will be handled under Danish law and may be brought before the Copenhagen City Court (Københavns Byret).
